Definitions:
“Goober” is defined as the legal entity known as Get A Goober, LLC and reserves all rights applicable to a Florida Limited Liability Company, as established by Florida law.
“Rider” is defined as the requesting individual and/or accompanying party, which is treated as an agent of the rider. Riders acknowledges and agree to all Terms and Conditions as outlined in this document for themselves and on behalf of all riders included in the group. Riders agree that they are 18 years of age or older, or will be accompanied by a member of the accompanying party on every trip that is 18 years of age or older.
“Driver” is defined as the operator of a Goober vehicle. Drivers are employees of Goober and as such, are fully licensed, insured, and have completed required background checks in order to operate Goober Vehicles. Drivers are responsible for the accurate and total completion of a Rider’s Trip, and have dedicated access to the Driver platform used by Goober in order to communicate and complete Rider’s requested contract. Drivers have the ability to end a Trip for any reason if a Rider or accompanying party violate safety precautions within a Goober vehicle, or at any time during or before the commencement of a Trip at their discretion.
“Trip” is defined as a short-term transportation contract between the Rider and the accompanying party and Goober. A contract begins when each individual ride request is submitted by Rider. This contract and all accompanying liability and responsibility of Goober ends when the ride is completed by Driver or Rider, whether or not a ride reaches the original destination, an altered destination, or is ended early for any reason.
“Fare Estimation” is defined as the current pricing structure implemented by Goober, which is outlined in this document and is subject to change at the discretion of Goober. Fare Estimation is provided to the rider upon request of each individual ride. Fare Estimation is inclusive of Cart Fee and Ride Rate. Ride Rate will be outlined and provided via the Goober Mobile Application at the booking of each ride request. Rider’s acceptance of the Fare Estimation is treated as agreement by the Rider for the rate as outlined at the time of request. Actual charged fare is based on the physical drop off location and may be subject to a reduction in, or increase of charges. This term can be used in place of and is intended to mean the same thing as “Trip Charge” or anything similar regarding the fare charged for transportation services provided to Rider by Goober.
“Cart Fee” is defined as the non-refundable fee charged to a Rider’s preferred payment method, covering the base cost of a ride, regardless of total trip distance. A Cart Fee will not be refunded if a requested driver has arrived to a pickup location prior to the ride being cancelled and is charged based on total number of vehicles required to service a Rider and accompanying party members. Each vehicle utilized for a Rider’s contract will carry no more than legally able as determined by Florida law. Multiple carts may be required to service a party larger than seven passengers.
“Ride Rate” is defined as the distance charge applicable to each Rider and accompanying party member, which is based on distance traveled while onboard a Goober vehicle.
Definitions (cont.):
“Goober Account” is defined as any account created by a user or Rider of the Goober Mobile Application, whether they request a ride within this Application or not. At the creation of such account, users agree that information provided and services outlined therein and within these Terms and Conditions are the property of Get A Goober, LLC and Riders authorize Goober to use this information for no purpose other than providing services during a contract. Account holders agree that they are 18 years of age or will be accompanied by an adult of 18 years or older while riding in Goober vehicles.
“Scheduled Ride” is defined as any ride requested more than 30 minutes in advance. Scheduled Rides are subject to the availability of Drivers, and rides may be cancelled by either party for any reason, so long as this cancellation occurs more than 15 minutes in advance. Scheduled Rides cancelled within 15 minutes of pickup may be subject to a cancellation fee.
“Geographical Operating Territory” is defined as the area of service that Goober vehicles provide on-demand service and contracts within. Geographical Operating Territory is subject to expansion and contraction without notice and will be expressed as an unacceptable or impossible ride request based on pickup location and/or destination. Unacceptable rides will be met with a prompt offering Riders the option to call Goober directly in order to coordinate transportation outside of the current Geographical Operating Territory, which may be subject to increased rates. Geographical Operating Territory is available to Riders via the Goober Mobile Application.
“Preferred Payment Method” is defined as the methods of payment Riders link to their profile, including but not limited to credit/debit cards, PayPal accounts, and other means of compensation for services. If a Rider’s Preferred Payment Method is deemed invalid, supplemental payment methods listed on the Rider’s account will be charged. If no alternative methods are linked, Goober has the authorization to attempt collection via the Preferred Payment Method continuously until any unpaid balance is resolved. A Preferred Payment Method will be required in order for Riders to successfully request a ride, and Riders will not be able to successfully place a subsequent ride until prior balances are resolved.
Services Provided:
Goober provides short-term transportation solutions, including golf carts and other motorized vehicles, offered on an as needed basis. Riders will download the Goober Mobile Application to create a Rider profile which requires a preferred payment method. Once a Rider’s Account is completed, Riders have access to on-demand rides that fit their specific needs and for their own use, so long as the pickup location and destination fall within Goober’s Geographical Operating Territory. Updates to these territories will be reflected in real time and will be shown on the Goober Mobile Application. Goober Drivers are notified of a Rider’s request and proceed at an agreed upon time and location of the Rider’s choosing, as efficiently as possible. As Drivers arrive, Riders are able to track a Driver’s location and should proceed to the designated pickup location in a timely manner. Trips have a previously agreed upon destination and route, which is determined by the Goober mobile application. Routes taken may be altered by a Driver’s real time knowledge of the Geographical Operating Territory. Trips may be ended early at the discretion of Rider or Driver. If a Trip is ended early, the quoted Fare Estimation will still remain valid unless explicitly verbalized by Goober staff. Drivers reserve the right to end Trips early if encountered with, but not limited to the following conditions: unsafe weather or road conditions, unsafe or inappropriate behaviors taken by the Rider or their accompanying party. Riders or a member of their accompanying party may also request to end the Trip at any time. It is at the Driver’s discretion to determine a safe and appropriate place to end the ride.
Anticipated Timeline of Ride:
Upon Rider’s confirmation of a Trip request, Goober makes every effort to arrive to the pickup location or an area accessible to the pickup location at the estimated time shown through the Goober Mobile Application. Goober cannot control and takes no responsibility for outside factors impacting this arrival time which may cause undue delays or lost opportunities. These outside factors include but are not limited to unpublished or unforeseen road closures, traffic impairments of any sort, and vehicle malfunctions. Upon notice of any of the listed or otherwise impacting factors, Goober will make every effort to contact the Rider to notify them of this change. Upon receipt of this notification, the Rider is free to cancel their ride without penalty.
Distance Rate and Applicable Charges:
Goober charges a Cart Fee for each cart required to service Rider and their accompanying party. Goober vehicles will hold no more passengers than legally allowed by Florida law. Ride Rates are also charged for each trip. Ride Rates are based on the distance of each individual ride and number of Riders in a party. Rides cancelled early, or before reaching the scheduled destination for any reason are subject to the charges accumulated up to that point, and will not be less than the estimated fare unless explicitly verbalized by Goober Drivers. Once requested, Trips cancelled by Riders after a Driver has been assigned and dispatched, up until the time Rider and/or accompanying party board the vehicle are subject to a refund up to the full Ride Rate. Once a trip has been initiated with the Rider and any accompanying party, the Ride Rate is no longer refundable and will be reviewed by Goober staff on a case-by-case basis. Regardless of cancellation timeline, Cart Fees are non-refundable unless the cancellation request is received prior to dispatching of the assigned driver.
Terms of Payment:
Each Trip will be processed as an individual transaction. A subsequent tip amount added, if any, is processed as a separate transaction. Payments are processed via the Rider’s preferred payment method, as chosen in the Goober Mobile Application. Riders agree that upon request and confirmation of a Ride, the Rider has authorized Goober to process any payment applicable to their Ride or cancellation thereof at the time of request and confirmation. Full payment will be made available at the immediate completion of each ride. If, for any reason, funds are not made immediately available by Rider’s Preferred Payment Method, Riders agree for this amount due to be processed on supplemental payment methods listed within their Goober Account. For a transaction attempted by Goober which is declined for any reason, Riders acknowledge their liability for the full amount payable will remain until processed and approved. Riders will not be able to utilize Goober services until this transaction has been processed and cleared. If this balance persists after attempting to charge all applicable payment methods, Riders agree to allow Goober to debit this outstanding balance amount from any additional payment method uploaded, whether this payment method is new to the account or has been added previously. Goober reserves the right to process any unpaid balances for up to one year after the ride has been completed. Upon successful payment of any outstanding balance, full access to the Goober Mobile Application will be immediately reinstated.
Payment Charged to Account:
Users agree that, upon request, fare amounts can be charged by Get A Goober via their linked payment methods. Payments in this way will be subject to additional driver gratuity, which will be added to the total for each individual ride taken. Payments collected by Get A Goober in this way will not currently be listed in the mobile application, and receipts detailing each ride fare and charged amounts will be made available upon request. These receipts can be sent via email, and a valid email address must be presented for delivery of this receipt.
Refund Policy:
Get A Goober, LLC does not offer refunds for completed rides. Services are provided on an as needed basis, where Rider’s use of these services acknowledges that Goober will not provide a refund for completed or partial rides, nor for cancellation charges applicable to Scheduled Rides. Rides cancelled and not fully refunded are subject to the review by Riders and Goober support staff within 14 days of the original transaction. Refunds not processed or disputed within this timeframe are subject to review of Goober at the time of notification from the Rider. Riders will notify Goober and allow a full review on a case-by-case basis prior to seeking remediation of the matter by any other means. Riders cancelling rides early at a new destination are responsible for the charges accumulated up to that point which may or may not be the full distance rate.
Liability Limitations:
Goober agrees to provide a convenient and timely arrival of all passengers to their destination. Riders agree and acknowledge that they are of sound body and mind and make the best effort not to intentionally harm or jeopardize the safety of themselves, the Driver, or any of the accompanying party while on board a Goober vehicle. Riders are required to use all safety restraints and devices in compliance with all local laws and regulations while being transported by Goober. This agreement is determined to be accepted by Riders and their accompanying party when the a Ride is confirmed. It is the sole responsibility of the Requesting Rider to inform members of the accompanying party of the contents of the policy listed herein as they prepare for the upcoming Ride. Goober will not be held responsible for negligent or intentional actions taken by other parties on public roadways, private roadways or on private property resulting in the mental or physical harm of any Rider or member of the accompanying party. Riders agree that any dispute arising from negligence or intentional actions of an outside party will be handled by arbitration and waive their right to a court trial for the purpose of holding Goober liable for these actions.
Lost Property:
Goober will make every effort to return lost items as they are discovered within a vehicle at the time of discovery. Lost items will be held in the main administration and dispatch offices of a local Goober operation. Goober cannot be held liable for items that are misplaced, damaged, or lost during the completion of a Trip or once the Trip has been completed. Goober agrees to keep found property locally and immediately available for a term of 60 days following a completed Trip, at which point items will be disposed of and unaccessible to Riders.
Privacy Statement:
Goober will not use, copy, adapt, alter any personal Rider information disclosed in order to create a Goober Mobile Application profile. This information includes but is not limited to, Rider’s phone number, payment methods, current location, or other specific profile information. This obligation will not apply to information which Goober has in its own possession at the time received or obtained, or which Goober obtains from some other person with good legal title to it, or which is in or comes into the public domain otherwise than default or negligence of Goober, or which is independently developed by or for Goober. Further information on Rider’s privacy while using the Goober Mobile Application is available within the Goober Privacy Statement, which Riders are required to read and accept prior to riding on any Goober vehicle.
Use of Application:
Users agree that by using the Goober Mobile Application their intent is solely to utilize services provided by Goober through it’s normal operating processes and will not be used for any purpose other than those directly relating to these processes. All applications, information, and processes utilized by Goober while performing operations is the sole property of Goober and shall not be used for any purpose outside normal business operations. Furthermore, information provided to Goober by Riders via the Mobile Application will be used for the purpose of normal business operations and for the purpose of providing the best possible service to Riders.
Miscellaneous:
a. The failure of either party to enforce its rights under this Agreement at any time shall not be construed as a waiver of such rights.
b. If any part, term or provision of this Agreement is held to be illegal or unenforceable neither the validity or enforceability of the remainder of this Agreement shall be affected.
c. Neither Party shall assign or transfer all or any part of its rights under this Agreement without the consent of the other Party.
d. This Agreement may not be amended for any other reason without the prior acknowledgement of both Goober and Riders.
e. This Agreement constitutes the entire understanding between the Parties relating to the subject matter hereof unless any representation or warranty made about this Agreement was made fraudulently and, save as my be expressly referred to or referenced herein, supersedes all prior representations, writings, negotiations or understandings with respect hereto.
f. Neither Party shall be liable for failure to perform or delay in performing any obligation under this Agreement if the failure or delay is caused by any circumstance beyond its reasonable control, including but not limited to acts of god, war, civil commotion or industrial dispute.
g. Any and all disputes with the Terms and Conditions herein are subject to review and arbitration under the sole jurisdiction of Walton County, Florida.
h. These Terms & Conditions, as well as all information provided by Get A Goober, is considered proprietary and is the sole property of Get A Goober, LLC. Any duplication or reproduction of this information for any use not originally created for will be punishable to the maximum extent under law.
